BILLING FOR MEMBERSHIP By submitting this agreement, you have authorized the club to bill your bank account or credit card for your dues. Your account will be billed for the amount specified (plus any additional fees for membership add ons selected). A service charge will be applied for each payment returned as uncollectible. Dues Renewal Term Your membership will automatically renew on a month to month basis after the expiration of the minimum number of payments. After the expiration date of the agreement, our membership will renew on a month-to-month basis at the current rate of your monthly dues. The club will continue to bill your credit card for your monthly dues as set forth in this Agreement. As a month-to-month member, you may cancel your membership into the Club and giving notice of cancellation in person at any time thirty (30) days or more before the last billing date. Your bank account or credit card will continue to be charged until your membership is properly cancelled. Annual Fee Terms Each member enrolled on a monthly membership will be charged a $35.00 fee forty five days from the start date of the agreement. Proceeds of this fee will go toward new equipment, facility upgrades, and operating expenses of the facility. Membership Terms and Conditions 1. Billing for Monthly Dues: By signing this agreement you have authorized Fitness 500 Club to Debit your bank account or credit card for your monthly dues. If Fitness 500 Club is unable to collect your monthly dues for any reason, Fitness 500 Club may double bill your account the following month plus impose an administrative fee of $20.00 without further notice to you. If your monthly dues are delinquent for two or more months, the management of Fitness 500 Club will have the option of voiding this agreement with the remaining term to be payable in full. Fitness 500 Club reserves the right to forward all delinquent accounts to Club Systems, our membership billing company. A 30 day written notice is requires to change monthly billing. 2. Cancellation: A 30 day written notice is required to stop monthly billing. Cancellation, for any reason, before the expiration date of the minimum term will result in a $100 administrative fee per person, to be assessed on the final monthly bill. You cannot cancel by fax or email. 3. EFT memberships are transferable for a $50.00 fee. Transferee must sign a minimum of 12 month EFT. Membership. Transfer must be within minimum monthly term. 4. Freeze Option: You may freeze your membership for a maximum period of three months for any reason during the course of this agreement for a fee of $7.00 per month. If this option is exercised, Fitness 500 Club will extend the agreement for those months. A 15 day written notice is required to change monthly billing. Annual facility fee will still apply if membership is on freeze.

WAIVER OF LIABILITY NOTICE TO MEMBERS: The Member is entitled to a completely filled in copy of this Agreement. The Member acknowledges that they have been told (A) That this document is an Agreement and will become legally binding upon it acceptance by Fitness 500 Club; (B) The terms and conditions of this agreement; (C) That they acknowledge that they have examined the facilities and that they accept them in the present condition, and the Member voluntarily assumes any and all risk involved in the use of the facility and equipment and releases the club from all claims and liabilities; (D) There are no warranties either expressed or implied which extend beyond this agreement.

YOUR CONTRACT TERMS THE Member is entitled to a completely filled in copy of this agreement. The member acknowledges that they have been told (A) that this document is an agreement and will become legally binding upon its acceptance by fitness500 club; (B) Ther terms and conditions of this agreement; (C) that they acknowledge that they have examined the facilities and that they accept them in the present condition, and the Member voluntarily assumes any and all risks included in the use of the facility and equipment and releases the club from all clains and liabilities; (D) There are NO warranties either expressed or implied which extend beyond this agreement.
